Terms of Service

1. Acceptance of Terms

By accessing or using BrandKity you confirm that you are at least 16 years of age (or the minimum age of digital consent in your jurisdiction), have the authority to enter into these Terms, and agree to comply with them. If you do not agree, you must not use the service.

2. Your Account

You are responsible for:

• Keeping your account credentials secure and confidential.
• All activity that occurs under your account, including actions by team members or collaborators you invite.
• Ensuring that account information (name, email, billing details) remains accurate and up to date.

You must notify us immediately at info@brandkity.com if you suspect unauthorized access.

3. Acceptable Use

You may not use BrandKity to:

• Violate any applicable law or regulation.
• Infringe the intellectual property, privacy, or other rights of any third party.
• Upload, distribute, or transmit content that is unlawful, harmful, threatening, defamatory, obscene, or otherwise objectionable.
• Introduce malicious code, viruses, or any software that could damage or interfere with the platform.
• Attempt to gain unauthorized access to any system, data, or account on BrandKity.
• Resell, sublicense, or otherwise exploit BrandKity commercially without our written permission.

4. Intellectual Property

BrandKity and its underlying software, design, trademarks, and content are owned by Webriy. You retain ownership of the brand assets and content you upload to your BrandKits. By uploading content, you grant Webriy a limited, non-exclusive licence to host, display, and deliver that content to authorised viewers of your BrandKit.

5. Billing and Payments

Paid plans are billed via our payment provider (Stripe) on a monthly or annual cycle. All fees are in USD unless stated otherwise. You authorise us to charge your payment method on the applicable billing cycle.

We offer a 14-day money-back guarantee on first purchases of paid plans. Renewal charges after the initial term are non-refundable except where required by law. See our Refund Policy for full details.

6. Plan Limits and Fair Use

Each plan comes with defined limits for BrandKits, workspaces, storage, and collaborators as published on our Pricing page. We reserve the right to throttle or suspend accounts that significantly exceed published limits or abuse platform resources.

7. Third-Party Services

BrandKity integrates with third-party services (Supabase, Cloudflare R2, Stripe). Your use of those services is also subject to their respective terms and privacy policies. Webriy is not liable for the actions or data practices of third-party providers.

8. Termination

You may cancel your account at any time from account settings. We may suspend or terminate your account immediately and without notice if you breach these Terms or engage in conduct harmful to the platform, other users, or Webriy.

On termination, your access to the platform ceases. Kit data may be retained for up to 30 days for recovery requests before permanent deletion.

9. Disclaimer of Warranties

BrandKity is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free from harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Webriy's total liability for any claims arising out of or relating to these Terms or your use of the platform shall not exceed the fees paid by you to Webriy in the 12 months preceding the claim. Webriy is not liable for indirect, incidental, consequential, or punitive damages.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts located in Noida, Uttar Pradesh, India, except where mandatory consumer protection laws in your jurisdiction require otherwise.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of BrandKity after changes take effect constitutes acceptance of the updated Terms.
